Although Pedro Jimeno and Chantel Jimeno (née Everett), stars of The Family Chantel, are divorcing, their legal separation “has no impact on his ability to apply for U.S. citizenship,” says Atlanta attorney Emily Davis of the Ross and Pines law firm exclusively to In Touch, adding that Pedro “must wait four years and nine months from the date of his green card issuance to apply for citizenship.”

Pedro’s divorce from Chantel, who is a U.S. citizen, does not guarantee he will be deported, Davis said. “As a lawful permanent resident, he is still entitled to stay in the United States.

In general, a lawful permanent resident who has a 10-year green card does not lose his or her green card through a divorce, but there are a few exceptions: committing certain crimes or ceasing to reside in the United States.

Even without Chantel Jimeno‘s help, Pedro is a “lawful permanent resident” and can apply for US citizenship on his own, Davis adds.

When Pedro’s K-1 visa was approved, Chantel may sponsor his green card application. If this happened, she would be financially liable for Pedro, Davis says. In order to qualify for Social Security benefits, he must become a US citizen, work for 40 quarters under the Act, leave the country, or die.

Chantel’s green card petition constitutes a legally enforceable contract between her and the United States government, according to Davis’s assessment.

In that agreement, the sponsor is obligated to support the sponsored immigrant at 125 percent or greater of the U.S. Poverty Guidelines.” There is no automatic termination of the contract in the event of divorce.”

According to court documents obtained by In Touch, Pedro filed for divorce from his wife on May 27th, citing their marriage as “irretrievably broken” as the cause for their formal separation and the date of their separation as April 27.

It’s unclear what exactly Pedro Jimeno alleges in his July 7 response to Chantel’s allegations of “adultery” and “cruel treatment,” including “physical domestic violence as well as mental agony,” but Pedro claims that Chantel withdrew more than $257,000 from their joint account.

A mutual restraining order was established for the two of them as a result of his filing, and they are now bound by it. A lawyer representing Chantel had no response when reached by In Touch about Pedro’s initial petition, and a lawyer for Pedro did not immediately respond to In Touch’s request for comment on Chantel’s claims.
